Earwitness

One July night in 1995, Deputy Sheriff William G. Hardy was shot behind the Crown Sterling Suites hotel in Birmingham, Alabama. At the same time as the murder, at least ten people saw Toforest Johnson four miles away, at a popular nightclub called Tee's Place. But detectives zeroed in on him as a main suspect in Deputy Hardy’s murder anyway, ultimately resulting in Toforest being tried, convicted, and sentenced to death. For over a quarter century, Toforest has been confined to a 5’ by 8’ cell on Alabama’s death row.

In 2019, investigative journalist Beth Shelburne began covering the case, going down a disturbing rabbit hole revealing many unsettling facts that cast grave doubts about Toforest’s guilt. The facts she found tear at the very foundation of the American criminal justice system: No eyewitnesses or physical evidence tied Toforest to the murder; the state tried to convict a different man for the same crime; and perhaps most disturbing of all, Toforest’s conviction relied on an ‘earwitness’ – a woman who claimed to have eavesdropped on an incriminating phone call, a woman whom prosecutors paid for her testimony, in secret. That payment was not disclosed to the jury, Toforest, or his lawyers until after he had been on death row for 17 years.

    Wonderful narrator, well researched & thoughtful discussions. This story is shocking, dismaying & really highlights a shameful abuse of our justice system. Not just for the innocent man on death row but for the poor sheriff’s family that got cheated out of justice & lied to.     This is a very well done, well produced podcast about an astonishing miscarriage of justice. The host does an excellent job of shining a light on everything that went wrong here. Yet again, prosecutorial questionable ethics and outright misconduct by the DA office sent another man of color to prison for a crime he had no involvement in. Spread the word about this podcast and help get Toforest Johnson freed and back to his family and friends.

    Too much unnecessary info
    I've already lost patience with the first episode. Who cares that one of the suspects retrofitted his car or how he did it? That took about 5 minutes. We also hear about the last time someone saw the deceased and what he said, and of course the insipid question "How did you feel when you heard he had died"? Podcasters need to learn to tell the actual story, and not try to make it an emotional journey.

    Beth Shelburne did an amazing job uncovering the truth behind this murder conviction. The justice system failed on all fronts in this murder case. There are many more that were prosecuted and convicted erroneously and sadly, Alabama is the worst state in the nation to correct their wrongdoings. Our laws inhibit the testing of DNA, even when the evidence has never been tested. Prosecutors and law enforcement and Judges refuse to open the door for corrections to be made because of their own egos. Maybe they are afraid they will be sued for their wrongdoings. Hopefully, more attention will be focused on this wrongful conviction because of this podcast!

    My heart is so sad but the journalism was fantastic on this story. The state of Alabama should be ashamed of themselves for keeping this man on death row and not owning up to the terrible injustice they've caused.

    Gripping story interrupted by more commercials than I’ve ever heard on a pod. They’re embedded so even with a paid subscription you can’t get away from them. Iheart radio is by far the most ad riddled of the big hitters. Annoying enough not to finish.

    Gripping story of an innocent man still on death row
    I do a lot of driving so I listen to tons of podcasts. This one is one of the best I’ve heard in years. Journalist Beth Shelburne knocked this story out of the park and left no stone unturned. Just when you think the story can’t get more unbelievable, the State of Alabama doubles down. Twists and turns, interviews, and incredible story telling. This is the podcast of the year!

    Fantastic podcast. Beth is a wonderful interviewer and storyteller. As a native Alabamian and resident of Birmingham, I think this should be required listening for others in the state— to bring needed attention to both Toforest’s story and the injustice done by the system that is supposed to hold people innocent until proven guilty.

    Every American Needs to Hear This!
    You do not have to look outside our country to find trumped up charges and innocent people incarcerated, or worse yet, executed, despite their innocence. And it’s happening in real time, not the distant past. This podcast covers all the bases and left me feeling shocked and despondent regarding our justice system. If you wish to hear how charges and witnesses can be shifted to fit the current need (or even bought!), and how justice in certain courtrooms is just an illusion. It’s eye opening, and the innocent person at the center of this dark tell is a real man, one who has been on Alabama’s Death Row for over 25 years. His youth and his freedom was taken, and now they want to take his life. Listen and weep.

    A must-listen compelling podcast
    The investigators of this monumental miscarriage of justice did years of extensive research and interviews to uncover the repeated use of testimony (to put it mildly) provided by unreliable witnesses and concealed exculpatory evidence. The perceived urgency for prosecutors to find and convict the murderer(s) of a law enforcement officer fueled their flawed investigations and practices which they then covered up. Make listening a priority, then share Toforest Johnson’s story.

    Hard to Listen to.
    I found it difficult to listen to due to the injustices portrayed. Such a shame. Also, it was literally difficult to listen to due to the narrator’s “newscast” style and inflection. I really wish it was narrated in a storytelling format, like typical podcasts and not like a TV broadcast. So annoying.

    Love that the reporter went to great lengths to get a full picture of the case and everyone involved. I cringed at some of the interviews because I honestly don’t think I would have had the courage to confront people, like the prosecutor, who is now retired.

    I just finished this podcast and I have so many emotions. I was hanging onto every word. I can’t believe my ears and how unjust this situation is. It seems so easy to fix because all of the information they have to get him out. I wish I could do something. Seems just so unfair for he and his family.     I listen to a lot of wrongful conviction podcasts but I think this might be the most infuriating. How in the world did juries find them guilty? And why would detectives not want to find the person who killed one of their own? Because there is no way they thought they had the right people. Excellent reporting - a story that needs to be told.

    I knew, after listening to the trailer, that this case was going to make me angry. Beth & her team do an excellent job of investigating & breaking down the obvious corruption in Toforest’s case & others. It’s appalling! Toforest needs to be released or at the least deserves a new trial.
